Abstract

This invention provides a new family of dietary supplements containing polyunsaturated fatty acids, a probiotic culture, and optionally hydrolyzed collagen. The prototype supplement contains cranberry seed oil as a source of omega-3 and omega-6 fatty acids, along with Vitamin E. The prototype supplement also contains a special strain of Lactobacillus casei as well as fish collagen. Nutritional supplements of this invention can be provided in capsule or tablet form, or as a food item such as a chocolate confectionary. Each of the three ingredients confers benefits on their own, allowing the consumer to get three nutritional supplements in the convenience of a single product. The ingredients are also believed to work synergistically to achieve a wider and more durable overall effect. In human clinical trials, consumption of the dietary supplement was associated subjective observations of improvement in softness and moisture of facial skin, reduction in wrinkles, and improvement in function of the gastrointestinal tract.

Claims

AMENDED CLAIMS received by the International Bureau on 08 April 201 1 (08.04.201 1) CLAIMS The invention claimed is:
1. A dietary supplement formulated for oral consumption by human subjects, comprising at least 200 mg polyunsaturated fatty acids and at least 5 x 108 CFU's of probiotic bacteria per gram.
2. A dietary supplement formulated for oral consumption by human subjects, made by a process that includes:
a) obtaining or providing a source of lipids containing at least 400 mg per gram of polyunsaturated fatty acids per gram; and
b) adding at least 1 x 109 CFU's of probiotic bacteria per gram of lipids,
wherein the supplement produced according to the process comprises a least 200 mg polyunsaturated fatty acids per gram.
3. The supplement of either preceding clam, wherein the polyunsaturated fatty acids include at least 200 mg omega-3 fatty acids and at least 200 mg omega-6 fatty acids per gram.
4. The supplement of any preceding claim, wherein the polyunsaturated fatty acids are contained in a mixture of fatty acids extracted from one or more botanical sources.
5. The supplement of any preceding claim, wherein a source of the polyunsaturated fatty acids is cranberry seed oil.
6. The supplement of any preceding claim, which contains between about 400 and 800 mg of polyunsaturated fatty acids per gram.
7. The supplement of any preceding claim, wherein the probiotic bacteria are Lactobacillus casei.
8. The supplement of any preceding claim, wherein the probiotic bacteria are L. casei strain KE-99 (ATCC accession no. PTA-3945).
9. The supplement of any preceding claim, which contains between about 2 and 20 billion CFU's of the probiotic bacteria per gram.
10. The supplement of any preceding claim, also comprising a separate source of amino acids.
1 1. The supplement of claim 10, wherein the amino acid source is hydrolyzed collagen from fish.
12. The supplement of any preceding claim, which contains between 50 and 500 mg of protein or free amino acids per gram.
13. The supplement of any preceding claim, further comprising a substantial amount of vitamin E per gram.
14. A nutritional supplement for administration to human subjects, comprising at least 200 mg of polyunsaturated fatty acids from a botanical source, 1 x 109 CFU's of probiotic bacteria, and 100 mg of hydrolyzed collagen per gram.
15. The nutritional supplement of claim 14, comprising at least 200 mg of cranberry seed oil.
16. The nutritional supplement of claim 14, wherein the probiotic bacteria are Lactobacillus casei.
17. The nutritional supplement of claim 14, wherein the collagen has been obtained from fish.
18. A pharmaceutical capsule or tablet for oral ingestion containing at least 500 mg of the nutritional supplement of any preceding claim.
19. A chocolate confectionary containing at least 500 mg of the nutritional supplement of any of claims 1-17.
20. A method for preparing the supplement of any of claims 1 to 19, comprising combining a probiotic culture, a polyunsaturated oil, and optionally hydrolyzed collagen in a capsule.
21. A method for preparing the supplement of any of claims 1 to 19, comprising formulating a probiotic culture, a polyunsaturated oil, and optionally hydrolyzed collagen in a chocolate confectionary.
22. A method for increasing bioavailability of polyunsaturated fatty acids in a subject, comprising providing to the subject for the purpose of oral consumption a supplement according to any of claims 1 to 19.
23. A method for supplementing microflora in the gastrointestinal tract in a subject, comprising providing to the subject for the purpose of oral consumption a supplement according to any of claims 1 to 19.
24. A method for improving health of the intestine or reducing gas the gastrointestinal tract of a subject, comprising providing to the subject for the purpose of oral consumption a supplement according to any of claims 1 to 19.
25. A commercial product, comprising a plurality of daily doses of a supplement according to any of claims 1 to 19, packaged in a container with written information on consumption of the product or possible use of the product to improve function of the gastrointestinal tract or affect skin health or appearance.
26. Use of a combination of at least 100 mg polyunsaturated fatty acids, at least 5 x 108 CFU's of probiotic bacteria, and optionally between 50 and 500 mg of collagen per gram, in the treatment of gastrointestinal upset.

27. A method for increasing bioavailability of amino acids in a subject, comprising providing to the subject for the purpose of oral consumption a supplement comprising:
• at least 100 mg polyunsaturated fatty acids,
• at least 5 x 108 CFU's of probiotic bacteria, and
• between 50 and 500 mg of protein or free amino acids
per gram of supplement.
28. Use of a dietary supplement comprising::
• at least 100 mg polyunsaturated fatty acids,
• at least 5 x 108 CFU's of probiotic bacteria, and
• between 50 and 500 mg of protein or free amino acids
per gram of supplement, for increasing bioavailability of amino acids in a subject.
29. The method or use of claim 27 or 28, wherein the supplement comprises at least 100 mg of hydrolyzed collagen per gram.
30. The method or use of claim 29, wherein the collagen has been obtained from fish.
31. The method or use of any of claims 27 to 30, wherein said polyunsaturated fatty acids are from cranberry seed oil.
32. The method or use of any of claims 27 to 31 , wherein the probiotic bacteria are Lactobacillus casei.
33. The method or use of any of claims 27 to 32, wherein the supplement is formulated as a chocolate confectionary.
34. A method for improving skin health in a subject, comprising providing to the subject for the purpose of oral consumption a supplement comprising:
• at least 100 mg polyunsaturated fatty acids, and
• at least 5 x 108 CFU's of probiotic bacteria,
per gram of supplement.
35. A method for improving facial appearance of a subject, comprising providing to the subject for the purpose of oral consumption a supplement comprising:
• at least 100 mg polyunsaturated fatty acids, and
• at least 5 x 108 CFU's of probiotic bacteria,
per gram of supplement.

36. Use of a dietary supplement comprising:
• at least 100 mg polyunsaturated fatty acids, and
• at least 5 x 108 CFU's of probiotic bacteria,
per gram of supplement, for improving skin health in a subject.
37. Use of a dietary supplement comprising:
• at least 100 mg polyunsaturated fatty acids, and
• at least 5 x 108 CFU's of probiotic bacteria,
per gram of supplement, for improving facial appearance of a subject.
38. The method or use of any of claims 34 to 37, wherein the supplement further comprises a source of amino acids.
39. The method or use of claim 38, wherein the supplement comprises between 50 and 500 mg of protein or free amino acids per gram.
40. The method or use of claim 38, wherein the supplement comprises at least 100 mg of hydrolyzed collagen per gram.
41. The method or use of claim 40, wherein the collagen has been obtained from fish.
42. The method or use of any of claims 34 to 41 , wherein said polyunsaturated fatty acids are from cranberry seed oil.
43. The method or use of any of claims 33 to 41 , wherein the probiotic bacteria are Lactobacillus casei.
44. The method or use of any of claims 34 to 43, wherein the supplement is formulated as a chocolate confectionary.
45. Use of a dietary supplement as hereintofore described with reference to Example 1.

STATEMENT UNDER ARTICLE 19(1)

The replacement claims are related to the claims in the application as originally filed as follows:

• Claims 1 to 23 are unaltered.

• Claims 24 to 26 are renumbered from previous claim 26, 27, and 30 as originally presented.

• Claims 27 to 44 are new. They are based on claims 14-17 and 24-25 as originally presented (indicated in the International Search Report as being novel and inventive), in combination with features from claims 10, 12, and 19.

• Omnibus claim 45 refers to effect of the dietary supplements of the invention on skin and facial appearance, as documented in the clinical study presented as Example 1.

The amendments do not go beyond the disclosure in the international application as filed.
